The jury acquitted Penny of criminally negligent homicide after previously deadlocking on the more serious charge of manslaughter.

Daniel Penny was acquitted Monday of criminally negligent homicide in the chokehold death of Jordan Neely, a 30-year-old homeless man with a history of mental illness whose final moments on a New York City subway train were captured on bystander video that set off weeks of protests and drew national attention.

The decision, on the fifth day of deliberations, came after the jury deadlocked Friday on the more serious charge of manslaughter, leading the judge to dismiss it. Penny faced up to four years in prison.

As the jury foreperson read the “not guilty” verdict, some observers in the courtroom applauded. Others began to audibly sob and yell, including Neely’s father, Andre Zachery, who was escorted out.

In 2007, when Neely was 14 years old, his mother was murdered by a man with whom she had been in an abusive relationship. Her body was found in a suitcase on the side of the Henry Hudson Parkway. Neely was called to testify at the trial. According to his aunt, Neely developed major depression, schizophrenia, and post-traumatic stress disorder after the murder of his mother. He was placed in foster care as a youth.

Neely had an extensive criminal record, including 42 arrests on charges including petty larceny, jumping subway turnstiles, theft, and three unprovoked assaults on women in the subway between 2019 and 2021. He was frequently homeless and had been involuntarily hospitalized for mental issues in the past. According to The Guardian, once Neely became homeless he slipped "into a cycle of mental health crises, arrests and hospitalization that would continue until his death".
